Rajbanshi was granted seven years of rigorous imprisonment and fined Rs 50,000. He was 22 years old at the time of the
incident that allegedly took place on August, 12, 2017 and was accused of raping a 161⁄2 years old girl.
 Reversing the conviction, a Single-Judge Bench of Justice Sabyasachi Bhattacharya observed that the victim was 161⁄2 years old then and wasn’t naive not to know the implication of sexual intercourse.
Earlier, the victim and her mom admitted that the victim & accused were earlier been in a relationship and after the alleged incident took place, her mom proposed to him to marry her daughter. But since he denied it was observed by court that the POCSO act has been used to pressurise the accused (boy) to get married to the victim (girl) which is shameful in the eyes of court. Also no external injuries were observed by doctors.
‘POCSO not a tool of abuse’
Furthermore, In its judgment, the court noted that according to the definition of a ‘child’ under the POCSO Act, “even a person who is aged 17 years and 364 days would qualify as a child, but her maturity would not be much different from another person, who was just one day older than her, that is, 18 years old”.
